1. The Service

Tim Costagliola helps small businesses generate and publish marketing content and replies using AI, including auto-replies to reviews, comments, messages, and email; brand-voice generation; content repurposing; and local search optimization. Features and limits depend on your plan.

2. Accounts

You must provide accurate information, keep your credentials secure, and are responsible for activity under your account. You must be authorized to act for the business you register and for any platform accounts you connect.

3. Your content and connected accounts

You retain ownership of your business content. You grant us a limited license to process it to provide the Service (for example, learn your voice, draft replies, publish posts you schedule).

When you connect a third-party platform (Google, Meta, X, LinkedIn, TikTok, email), you authorize us to access and act on that account as you direct, subject to that platform's terms.

4. AI output — your review and responsibility

AI-generated text may be inaccurate or inappropriate. You are responsible for content sent from your account, whether you approve it manually or enable automated sending.

The Service defaults to suggest-before-send (you approve replies). Auto-send is optional, off by default, gated by a confidence threshold, and excludes sensitive categories (for example, legal threats, refund demands, one-star reviews). If you enable auto-send, you accept responsibility for the automated replies it posts.

5. Acceptable use

You will not use the Service to violate any law or third-party platform's terms; post spam, deceptive, harassing, hateful, or unlawful content; impersonate others; infringe intellectual property; attempt to breach security or tenancy isolation; or generate content you are not authorized to publish. You will comply with the automation and rate policies of every connected platform.

6. Plans, billing & cancellation

Paid plans are billed via Stripe on a recurring basis. Current pricing is presented at checkout.

Plan limits (for example, replies sent, posts published) apply per billing period; exceeding a limit may block the corresponding action until you upgrade or the period resets.

You may cancel anytime via the billing portal; cancellation takes effect at the end of the current period. Fees already paid are non-refundable except where required by law.

7. Third-party platforms

The Service depends on third-party APIs we do not control. Their availability, terms, and approval decisions may affect features. We are not responsible for changes, suspensions, or actions taken by those platforms against your accounts.

8. Disclaimers

The Service is provided "as is" without warranties of any kind. We do not guarantee any marketing result, search ranking, AI citation, review outcome, or uninterrupted availability.

9. Limitation of liability

To the maximum extent permitted by law, our aggregate liability is limited to the amount you paid us in the 12 months before the claim, and we are not liable for indirect, incidental, or consequential damages.

10. Indemnification

You will indemnify us against claims arising from your content, your use of the Service, or your violation of these Terms or any platform's terms.

11. Termination

We may suspend or terminate accounts that violate these Terms or create risk to the Service or third parties. You may stop using the Service at any time; see billing above for cancellation effects.

12. Changes

We may update these Terms; material changes will be notified. Continued use after changes means you accept them.

13. Governing law

These Terms are governed by the laws of State of New York, USA, without regard to conflict-of-laws rules.
